PUBLIC NOTICE OF VACANCY AND PROVISIONAL APPOINTMENT California Education Code §5092 Joy Gutierrez-Pilare announced her resignation to the Board of Trustees effective July 8, 2022. As of the election filing deadline of August 12, 2022 there were not enough candidates for election to fill the open seats on the BESD Board of Trustees. This required the board to "appoint due to failure to elect". On October 27th, 2022 the BESD Board of Trustees held a Failure to Elect appointment process to fill the two vacant seats on the Board of Trustees. One Trustee was appointed during that process but one seat remained unfilled. In order to fill the remaining vacancy, the BESD Board of Trustees conducted a Provisional Appointment process on January 18, 2023 and voted to provisionally appoint Janelle Cabanero to serve as a Trustee until the next general election in November 2024. To challenge the appointment and order a special election, proponents must file a petition in the office of the San Mateo County Superintendent of Schools within 30 days from the date of the provisional appointment. The petition must contain: - valid signatures of at least 5 percent of registered voters of the district at the time of the last regular election for governing board members in districts with less than 2,000 registered voters.
