The Board of Directors of the Bay Area Air District (Air District) will conduct a public hearing at the Air District Headquarters' 1st floor Board Room, 375 Beale Street, San Francisco, California, on Wednesday, November 4, 2026, at 9:00 a.m., or as soon thereafter as the matter may be heard. The meeting is also accessible via Zoom on the Air District's website.
The Board will consider:
Adoption of proposed amendments to Regulation 9: Inorganic Gaseous Pollutants, Rule 6: Nitrogen Oxides Emissions from Natural Gas-Fired Boilers and Water Heaters
The Air District is issuing a Public Hearing Notice and is accepting comments on proposed amendments to Rule 9-6 and supporting materials.
Background:
On March 15, 2023, the Air District adopted amendments to Rule 9-4: Nitrogen Oxides from Fan Type Residential Central Furnaces and Rule 9-6: Nitrogen Oxides Emissions from Natural Gas-Fired Boilers and Water Heaters that govern point of sale emission standards for small, typically residential and commercial, water and space heating systems. Space and water-heating appliances generate a large portion of nitrogen oxide (NOx) emissions from sources in the Bay Area. NOx is formed during natural gas combustion when ambient nitrogen and oxygen combine at high temperatures. The amendments will substantially reduce NOx emissions from these appliances and therefore secondary particulate matter formation. Air District staff have published a Frequently Asked Questions and Myths vs. Facts Sheet to assist in the understanding of these amendments.
On November 4, 2026, the Air District Board of Directors will consider changes to Rule 9-6 for water heaters. The changes being considered would, if approved, provide for some exemptions to the zero-nitrogen oxides standard would extend the compliance date.
The Air District has released Proposed Rule Language, a Preliminary Staff Report, an Updated Socioeconomic Impact Analysis, and an Addendum to the Environmental Impact Report for the proposed affordability amendments for Rule 9-6 for water heaters. These materials are available on our main building appliances webpage.
The goal of the proposed amendments is to support practical implementation of Rule 9-6 while continuing to reduce harmful nitrogen oxide, or NOx, emissions from natural gas-fired water heaters.

Comments:
The proposed amendments to Rule 9-6 and supporting materials are being published for public review and comment. The Staff Report outlines the rationale for the proposed rule amendments, regulatory context, discussions on expected impacts of the amendments, and socioeconomic analysis. Air District staff has prepared an addendum to the Air District's 2023 Environmental Impact Report (EIR) for Rule 9-6 pursuant to the California Environmental Quality Act (CEQA) describing the amendments and discussing why a subsequent or supplemental EIR is not required.
We are seeking public comments on the Proposed Rule Language and Preliminary Staff Report ahead of the Board of Directors meeting on November 4th.
The public comment period will close on November 1st at 6 PM. Online comments must be submitted through the Air District's public comment tool to be considered. Under Air District policy, we cannot consider comments on regulations that are submitted by email. Written comments can also be submitted by mail to Rule Development, Bay Area Air Quality Management District, 375 Beale Street, Suite 600, San Francisco, CA 94105. Verbal comments are welcome up to the day of and during the Public Hearing.
