NOTICE OF AVAILABILITY OF A PARTIALLY RECIRCULATED ENVIRONMENTAL IMPACT REPORT
The California Department of Resources Recycling and Recovery (CalRecycle), as the Lead Agency, has prepared a Partially Recirculated Draft Program Environmental Impact Report (PEIR) pursuant to the California Environmental Quality Act (CEQA) for the Plastic Pollution Prevention and Packaging Producer Responsibility Act (the Act), Senate Bill (SB) 54 (Allen, Chapter 75, Statutes of 2022), Implementing Regulations (Proposed Program). The Proposed Program would implement the requirements of the Act for producers of covered materials to source reduce plastic covered material and meet recyclability and compostability targets; for producers to establish a Producer Responsibility Organization (PRO) for the purpose of developing and implementing an Extended Producer Responsibility program for covered material; reporting and fee requirements for producers; and requirements for local jurisdictions and recycling service providers. It is reasonably foreseeable that meeting the Act's source reduction and recycling rates will require the development of infrastructure to optimize recycling and disposal waste streams, including collection, sorting, and processing facilities. A Draft PEIR was previously released for public comment on November 4, 2024. The Partially Recirculated Draft PEIR reflects changes to the Implementing Regulations and updates information in the environmental analysis to be consistent with the changes.
The Partially Recirculated Draft PEIR will be circulated for a forty-five (45) day public review period, beginning on August 26, 2025, and ending on October 10, 2025. An electronic copy of the Notice of Completion and Availability and the Partially Recirculated Draft PEIR is available at: https://ceqanet.lci.ca.gov/Project/2024070487
CalRecycle is requesting that anyone wishing to submit written comments on the Partially Recirculated Draft PEIR limit their comments to the revised portions of the Draft PEIR. CalRecycle is accepting comments on only the revised text contained in the Recirculated Draft PEIR (the text that is either underlined or struck through) during a 45-day review period (CEQA Guidelines, § 15088.5(f)(2).). CalRecycle is not accepting additional input on non-recirculated chapters of the Draft PEIR, or portions thereof, that remain unchanged, and was previously circulated for public review. Please send your written comments to CalRecycle by one of the following delivery methods.
